1. Acceptance of Terms

Welcome to Horai! These Terms of Service ("Terms") govern your access to and use of the Horai mobile application provided by Ecliptalab ("we", "us", or "our").

By downloading, installing, or using Horai, you agree to be bound by these Terms. If you do not agree, please do not use the App.

2. Description of Service

Horai is a time optimization application for iOS that allows you to:

  • ·Track and manage your time entries
  • ·Organize time logs by projects and categories
  • ·View reports and statistics about your time usage
  • ·Set reminders and notifications
  • ·Sync data across Apple devices via iCloud (premium feature)
  • ·Export your time tracking data

All data is stored locally on your device. Premium users may optionally enable iCloud sync.

3. Eligibility

You must be at least 13 years of age to use Horai. By using the App, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

If you are under 18, you must have your parent or legal guardian's permission.

4. User Account and Registration

Horai does not require you to create an account. The App functions independently on your device using Apple's native frameworks.

If you enable premium features, your purchase is managed through your Apple ID and subject to Apple's terms.

5. Premium Subscription

5.1 Premium Features

  • ·Unlimited time entries and projects
  • ·iCloud synchronization across devices
  • ·Advanced reporting and analytics
  • ·Export functionality in multiple formats
  • ·Custom categories and tags
  • ·Ad-free experience

5.2 Billing and Payment

  • ·Premium subscriptions are processed through Apple's App Store
  • ·Payment is charged to your Apple ID at confirmation of purchase
  • ·Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period
  • ·You can manage and cancel subscriptions through your Apple ID Account Settings

5.3 Free Trial

If offered, you will have access to premium features during the trial period. Unless cancelled before the trial ends, you will be automatically charged. You may cancel at any time through Apple ID Account Settings.

5.4 Refunds

All purchases are processed through Apple. Refund requests must be submitted directly to Apple according to their refund policy. We do not control Apple's refund decisions.

6. User Responsibilities

You agree to:

  • ·Use the App in compliance with all applicable laws and regulations
  • ·Keep your device and Apple ID credentials secure
  • ·Not reverse engineer, decompile, or disassemble the App
  • ·Not use the App for any illegal or unauthorized purpose
  • ·Not interfere with or disrupt the App's functionality
  • ·Not attempt to access premium features without a proper subscription

7. Data Storage and Privacy

7.1 Local Storage

All your data is stored locally on your iOS device using Apple's SwiftData framework, protected by iOS encryption.

7.2 iCloud Sync (Premium)

Premium users may optionally enable iCloud sync. When enabled, data is stored in your personal iCloud account and governed by Apple's iCloud Terms of Service.

7.3 No External Servers

We do not operate external servers that collect or store your data. All data remains within the Apple ecosystem.

7.4 Privacy Policy

Your use of Horai is also governed by our Privacy Policy.

8. Data Ownership and Export

You retain all ownership rights to the data you create within Horai. You may export your data at any time in various formats from Settings.

Upon uninstalling the App or deleting your data, all locally stored information will be permanently removed from your device.

9. Intellectual Property

The App, including all content, features, functionality, designs, graphics, and software, is owned by Ecliptalab and protected by international copyright and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

10. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the App will be uninterrupted, secure, or error-free, or that results obtained will be accurate or reliable. You are solely responsible for maintaining backups of your data.

11. Limitation of Liability

To the maximum extent permitted by law, Ecliptalab shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use arising out of or related to your use of the App.

Our total liability for any claims shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Ecliptalab and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of:

  • ·Your use of the App
  • ·Your violation of these Terms
  • ·Your violation of any rights of another party
  • ·Your violation of any applicable laws or regulations

13. App Updates and Modifications

We may update, modify, or discontinue the App or any features at any time without prior notice. We are not liable for any modification, suspension, or discontinuation of the App.

Updates may be required to continue using the App. You are responsible for ensuring you have the latest version installed.

14. Termination

You may stop using the App at any time by uninstalling it from your device. This will delete all locally stored data.

We reserve the right to terminate or suspend your access to premium features if you violate these Terms. All provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

15. Third-Party Services

15.1 Apple Services

The App integrates with Apple services including iCloud, StoreKit, and UserNotifications. Your use of these services is governed by Apple's Terms of Service and Privacy Policy.

15.2 RevenueCat

We use RevenueCat to manage subscriptions and in-app purchases, subject to their Terms of Service and Privacy Policy.

15.3 No Endorsement

We are not responsible for the content, policies, or practices of any third-party services. Your use of third-party services is at your own risk.

16. Dispute Resolution

16.1 Informal Resolution

If you have any dispute with us, please first contact us at horai-support@ecliptalab.com and attempt to resolve the dispute informally.

16.2 Governing Law

These Terms shall be governed by the laws of the jurisdiction in which Ecliptalab operates, without regard to conflict of law provisions.

16.3 Arbitration

Disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date and displaying a notice within the App. Your continued use after changes are posted constitutes acceptance of the modified Terms.

18. Apple-Specific Terms

You acknowledge that:

  • ·These Terms are between you and Ecliptalab, not Apple
  • ·Apple has no obligation to provide maintenance or support for the App
  • ·Apple is not responsible for addressing any claims relating to the App
  • ·Apple is a third-party beneficiary of these Terms and may enforce them
  • ·You must comply with applicable third-party terms when using the App
