Terms of Service for Horai

1. Acceptance of Terms

Welcome to Horai! These Terms of Service ("Terms") govern your access to and use of the Horai mobile application ("App", "Service", or "Horai") provided by Ecliptalab ("we", "us", or "our").

By downloading, installing, or using Horai, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

2. Description of Service

Horai is a time tracking application designed for iOS devices that allows you to:

• Track and manage your time entries
• Organize time logs by projects and categories
• View reports and statistics about your time usage
• Set reminders and notifications
• Sync data across your Apple devices via iCloud (premium feature)
• Export your time tracking data

All data is stored locally on your device. Premium users may optionally enable iCloud synchronization to sync data across their Apple devices.

3. Eligibility

You must be at least 13 years of age to use Horai. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

If you are under 18 years of age, you must have your parent or legal guardian's permission to use the App.

4. User Account and Registration

Horai does not require you to create an account or register with personal information. The App functions independently on your device using Apple's native frameworks.

If you choose to enable premium features, your purchase will be managed through your Apple ID and subject to Apple's terms and conditions.

5. Premium Subscription

5.1 Premium Features

Horai offers a premium subscription that unlocks additional features, including but not limited to:

• Unlimited time entries and projects
• iCloud synchronization across devices
• Advanced reporting and analytics
• Export functionality in multiple formats
• Custom categories and tags
• Ad-free experience

5.2 Billing and Payment

• Premium subscriptions are processed through Apple's App Store
• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions through your Apple ID Account Settings

5.3 Free Trial

If we offer a free trial period, you will have access to premium features during the trial. Unless you cancel before the trial ends, you will be automatically charged the subscription fee. You may cancel at any time during the trial through your Apple ID Account Settings.

5.4 Refunds

All purchases are processed through the Apple App Store. Refund requests must be submitted directly to Apple according to their refund policy. We do not have access to or control over Apple's refund decisions.

6. User Responsibilities

You agree to:

• Use the App in compliance with all applicable laws and regulations
• Provide accurate time tracking information for your own use
• Keep your device and Apple ID credentials secure
• Not attempt to reverse engineer, decompile, or disassemble the App
• Not use the App for any illegal or unauthorized purpose
• Not interfere with or disrupt the App's functionality
• Not attempt to access premium features without proper subscription

7. Data Storage and Privacy

7.1 Local Storage

All your time tracking data is stored locally on your iOS device using Apple's SwiftData framework. Your data remains on your device and is protected by iOS encryption.

7.2 iCloud Sync (Premium)

Premium users may optionally enable iCloud synchronization. When enabled, your data is stored in your personal iCloud account and synchronized across your Apple devices. This data is governed by Apple's iCloud Terms of Service and Privacy Policy.

7.3 No External Servers

We do not operate external servers that collect or store your time tracking data. All data remains within the Apple ecosystem (your device and optionally your iCloud account).

7.4 Privacy Policy

Your use of Horai is also governed by our Privacy Policy, available at Privacy Policy. Please review it to understand how we handle your information.

8. Data Ownership and Export

You retain all ownership rights to the time tracking data you create within Horai. You may export your data at any time in various formats (CSV, JSON, PDF) from the App's Settings.

Upon uninstalling the App or deleting your data, all locally stored information will be permanently removed from your device.

9. Intellectual Property

The App, including all content, features, functionality, designs, graphics, logos, and software, is owned by Ecliptalab and is protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, secure, or error-free
• The results obtained from using the App will be accurate or reliable
• Any errors in the App will be corrected

You are solely responsible for maintaining backups of your time tracking data and ensuring iCloud backup is enabled if desired.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ECLIPTALAB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Ecliptalab and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of or related to:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations

13. App Updates and Modifications

We may update, modify, or discontinue the App or any features at any time without prior notice. We are not liable for any modification, suspension, or discontinuation of the App.

Updates may be required to continue using the App. You are responsible for ensuring you have the latest version installed.

14. Termination

You may stop using the App at any time by uninstalling it from your device. This will delete all locally stored data.

We reserve the right to terminate or suspend your access to premium features if you violate these Terms, though your locally stored data will remain accessible.

Upon termination, all provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

15. Third-Party Services

15.1 Apple Services

The App integrates with various Apple services including iCloud, StoreKit (for in-app purchases), and UserNotifications. Your use of these services is governed by Apple's Terms of Service and Privacy Policy.

15.2 RevenueCat

We use RevenueCat to manage subscriptions and in-app purchases. RevenueCat's services are subject to their Terms of Service and Privacy Policy.

15.3 No Endorsement

We are not responsible for the content, policies, or practices of any third-party services. Your use of third-party services is at your own risk.

16. Geographic Restrictions

Horai is available through the Apple App Store and may be subject to geographic restrictions based on App Store availability in your region. We make no representation that the App is appropriate or available for use in all locations.

17. Dispute Resolution

17.1 Informal Resolution

If you have any dispute with us, you agree to first contact us at horai-support@ecliptalab.com and attempt to resolve the dispute informally.

17.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Ecliptalab operates, without regard to its conflict of law provisions.

17.3 Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association, except where prohibited by law.

18. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Updating the "Last Updated" date at the top of these Terms
• Displaying a notice within the App
• Sending a notification if required by applicable law

Your continued use of the App after changes are posted constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the App.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ecliptalab regarding the use of Horai and supersede all prior agreements and understandings.

22. Apple-Specific Terms

These Terms apply to your use of the App downloaded from the Apple App Store. You acknowledge that:

• These Terms are between you and Ecliptalab, not Apple
• Apple has no obligation to provide maintenance or support for the App
• Apple is not responsible for addressing any claims relating to the App
• Apple is a third-party beneficiary of these Terms and may enforce them
• You must comply with any applicable third-party terms when using the App
